H1B transfer from Academic to Industry

Hi all,

I have an H1B which expires by end of 2013 filed by a public University (non profit hence exempt from the yearly H1 cap ). I have now an offer by a company A (for profit).
1) Is it possible to transfer my current H1B?
2) If I want to start working for company A in December 2011, is this still possible?

Legally there is no time limit. You can join at any time and work up to the expiration date of LCA. When to join is entirely between you and your new employer.

I am in a similar situation. My h1B is from a non-profit university where I am currently employed and expires july 2014. I have an employer seriously interested in hiring me, industry, I looking up online and found mixed responses. Since the h1B cap has reached limit for 2014, I was wondering if my H1B is eligible for a simple transfer. Can you tell me what happened in your case. I hope you are still active in this forum :)

If your new employer does not qualify for a cap-exemption, you would be subject to the cap, and if the cap is reached (and it appears to be), the petition cannot be approved.
