H1b Transfer :confused:

Hi,

I have confusion of H1 Transfer

1. I am on H1B and want to switch Company A
to company B. Company A already filed for Green card 1 year before.

2. If I am transfering my H1b (A) to Company B will my Green card process stop or will it be continue.

and can my new employer i.e company B can file me a new Green Card through Perm process?

3. I applied H4 for my wife, so will it be good idea to transfer h1b to new company B or will it be any problem on her case?


Your help will be most appreciated.

Unless Comp A angry on you and withdraw the LC petition, the GC will go on processing.
and can my new employer i.e company B can file me a new Green Card through Perm process?

3. I applied H4 for my wife, so will it be good idea to transfer h1b to new company B or will it be any problem on her case?
better change it along with your H1 transfer, so that both will have same expiry date, she will not left behind.

Is PERM process valid.......

I am very thankful to you, for quick reply. :)

I am new to PERM, Can u Please advise me.

1. Is PERM process valid for all states or for NJ,PA.. Please guide?

2. I already filed gc last year and if i am filling through PERM, does it affect on previous case.

It applicable to all 50 States.

You can make use of your Perirority Date, by filing PERM and referencing your old LC, if the jobs are same description.
Better go through a good atorney,like our sponser Rajiv Khanna.

H1B Transfer Status!

I tried to search the forum and could not get an answer. So please bear with me if this question is already answered.

I am in my of H1B status with my current company A.
I have applied for new H1B transfer yesterday with Company B under Premium Processing.
My new Company B asking me to join once the H1B recipt notice is received which might take 3 weeks.

I am force to resign Company A tomorrow or monday. If I resign Will I be out of status till I join company B , since I am not working with Company A and Company B for 3 weeks ? Will I have a probelm in H1B transfer or any legal issue?

I am also considering the worst case if my company A cancels my H1B immediately....

Assume you are under company A , but vacation

Will I have a probelm in H1B transfer or any legal issue?

I am also considering the worst case if my company A cancels my H1B immediately.... Even A cancell you are not in problem as your H1 transfer is already filed.
