H1B - Transfer Clarification

Hi Friends,

I want to transfer my H1 to new company XXX. Company XXX promised to file my transfer on this week and they are asking me to join the company on next week. By next week i might get the H1B transfer receipt only.

So i am planning to quit my current company this weekend and join new company XXX by next monday.

In case my H1- B Transfer filed by my new company is rejected then what will happen to me??

How people are managing such scenerio? Do i need to wait for the approval of my H1B transfer before joining the new company.

I'm in a similar situation, we just filed the transfer and I was advised to wait until it is approved since it may get a RFE or a denial. Then I would be out of status.

Its really hard as my new employer wants a date and do not understand that it takes time for the approval (15 days)
My advice is to wait for an approval before quitting. However if you are not filing through the premium processing service then I think you can join the new company while it is in process....there is a portability clause.
Its a bit of a risk in my eyes.
