Hi Team/Rajiv, first time in this situation:
Travel Dates to India:
Departure: 23rd December 2024
Return: 7th January 2025
Here's what we have planned: New Employer will initiate my H1B transfer, with the hope that the transfer will be completed before my departure date to India on 23rd December. I will still be employed by my Current employer during this time, with a planned start date at New Employer on 13th January 2025.
From my end as soon as I receive a successful online notification of H1B transfer to New Employer, I will inform my current Employer (Manager) about my intent of leaving my Current Employer so that necessary Knowledge transfer arrangements can be made from his end to new resource and we get enough time for that to happen that smoothly, i do not want to burn bridges by giving a very short notice, that's why i am taking risk even to convey before i am leaving to India.
With the given scenario mentioned above at both the end. I would like to confirm if there will be any issues at the U.S. port of entry upon my return, considering that:
Could you please verify if this arrangement is compliant and if any additional steps or documentation would be required ?
Why I am asking this as if i travel with current employer’s I797 and present current employer’s I797 at port of entry in that case I94 of new employer I797 (which was already transferred) will not have port of entry dates of my latest travel updated, will that be an issue later or it will invalidate my transfer altogether ? I don’t know if I am overthinking or it;s something to worry about donot want to jeaopardize the plan and at the same time I am planning to telly my old employer that i would be leaving the company before travel so i want to straight out this situation before i travel, if there’s a risk I will prefer to decline offer and wait.
