H1B transfer and H4 Point of Entry Issue

Hi All

I am currently on H1B for company A and my wife is outside U.S and planning to enter U.S in 2nd week of Feb based on my H1b from company A. Company B is offering me a job and want me to join them ASAP. They want me to join them as soon as I get the H1B transfer receipt. Will there be any problems for my wife when entering on h4? Any legal issues?

I dont see any problems of your wife entering in to usa with older company visa..
For you its wise to apply for H1 transfer after your wife enter in to usa..so that her status also will be extended with the new company .. Other wise you need to file for her H4 extension separately..

she can enter on past employer Visa stamp.

"kishuibm" is correct that once she entres US on H4 status dont forget to file her H4 extension with USCIS using the form I-538 and that should be filed before her I-94 expiry date, if she has H4 visa stamp valid more than 6-7 months then i dont see any problem because she will have her I-94 valid for 6-7 months and if you file your H1 transfer now it may get approved in 3-5 months and once you get the H1 transfer approval notice you file her H4 extension before her I-94 expiry date and her H4 status will be extended till your H1 transfer approval notice

OR let your wife enter on H4 status ASAP and then file H1 transfer and her H4 extension at same time
