My wife is a H1B holder since Oct 2005 and I'm a US green card holder since Oct 2004. The reason she is on H1B being we got married after I received my green card.Currently she is on a 12 week maternity leave and would have to return to work in Feb 2008. The problem is she is not in position of going back to work due to health reasons besides wanting to take care of the newborn herself. Her H1B is held by a medium sized American company and I dont know if they are going to keep her H1B valid if she chooses to stay at home till I become a US citizen ( Jan 2010 )
So incase she stays at home for an extended period of time do the INS come track her down and deport her ?
