H1B Stamping on Passport

My wife is intending to go to India to have her VISa stamped on her passport.

My Concerns are
1) Her visa is expired for more than a year. I know she needs to take an appt.
2) Can I send my H1 Originals and my passport so I have it stamped on my passport my new VISa.

the only problem is Iam on the 7th yr extn and goign on a year by year basis , and the time it takes to get a appointment whcih is close to 3-4 weeks approximate.

Can I have this done or not??? Does anyone have any sort of a experience where in they (checnnai consultate) did stamp the passport if the person is resding in the United states.

If she is on H1 B status and also passport stamped old H1 B then stamp in USA.
Now a days, Chennai is not good for H1 B Stamping .
everyone sayinh that they are giving some Rfe and also it is taking so much time. Why don't you do it USA. It will take some time but it is good.

If Old H1B not stamped then she has to go to india or canada/Mexico.
no need your H1 B, but she has to take with her: Employer letter, Tax information, her Pay stubs, and all w2's.

I think I did not make myself clear.

Iam a H1b Holder and my wife is H4. She has H4 approval notice already with her, and I wanted to know if I can send my H1B paper work along with her with me being in the US and have just the VISa stamped on the Passport.

Either H4 also is not good India. Now a days they are asking lot of questions. Like Client Photos, Emploer office Photos and also they are wasting time. Better to stamp from USA. If she got H4 do it here then send it her to India.

Note: pls don't say sir, here all we are friends. I am not a lawyer. Just I read some sites then i am giving answers to our friends.
 
First sorry for saying Sir.. lets be friends...

She cannot have her Visa stamped on the passport due to her OLD Visa getting expired on Nov 2002 and here they do not approve visas if its more than a year OLD. She has to go and I also need to go.

Here is the list of docs that I have collected.
1) Her H4 approval notice (orig)
2) My H1B notice Copy.
3) My Passport copy.
4) Since My Visa is also stmpaed on the passport of Nov 2002 Iam furninshing details of March 2003 Expired approval notice/March 2004 Approval notice and March 2005 Approval notice.
5) My Photos(Like me being in fornt of the building which has my company logo)
6) OLD H4 Approval notices for my Wife Same as Mine Dates.
7) My W2 for Current Year and 1040 for the last 2 years.
8) My Current Pay Stub.
My attorney sent me a bunch of docs alomst 30-40 pages, whcih has all the documents that needed for h1B and H4 application, filing fees, somethign called 7th yr extn memorandum from the UCIS, my copies of my Marks Card starting from 10th grade to Masters, my employemtn letter, My Green card application and the Approval from NC and waiting stage from Atlanta all copies!!! As I said its more than 30-40 pages.
9) about 20-30 Photos of marriage
10) my Marriage certificate.

11) Ofcourse, last but not the least, appl for DS156 and filing fees and etc...

It hink I bored u... but still if u can think of anything else pls let me know.
 
I think you can stamp here. Coz, you people were not out of status. If you need to go out side the we can do stamping in our passports. I am not sure..

Ok, You have filled GC, I think you are waiting for your labor. If labor is going come with in a month then you can prepare all the papers for I-140,I485,EAD and AP then she can use AP.
 
I think this India-USA guy has not idea what he/she is talking about.

H1Buser2002 has been saying that revalidation in the US is not possible. This is absolutely true 'cause revalidation is only possible for this who have visas expired within one year.

H1Buser2002, the matter to think if whether you want your wife to travel overseas and try for a visa abroad. The risk is always there. She can try in Canada/Mexico but if refused, will have to leave for India directly.

My suggestion is that if your GC is pending, she can apply for AP and then travel.

Upstate_NY is right.

You cannot have your visas revalidated in US because your visas expired more than year, also you have to face interview since you are not eligible for the drop box for the same reason.

I think if you carry all the paperwork you won't have any problem wherever you go but since lot of people had bad experiences in Chennai, this might be little bit gamble.

But if you have to go then you don't have any other choice. One more thing where Upstate_NY is right is that you can make use of AP in case you have a pending I-485 application. If you have 485 pending and haven't applied for AP yet, it takes around 4 months to get the approval. If it is not something urgent then you can wait for AP approval or make a trip and hope for the best.

Ok, let it be. and regarding this issue, I think he is waiting for his LC. there is no otherway. thats why he is planning to send on H4/H1.
Now a days lot of friends are saying, they are getting Rfe's. If they provide everything then they are asking some other new one's.
That is depening on office and their luck also..............
