H1B 'Security Deposit'

Hi,

My wife (on H4) had approached a consultant for H1B quota filing in March end/april. He has encashed the 1500$ 'security deposit' cheque, but we no longer want to continue with him due to various reasons.

How can we ensure he returns the deposit when we have no reciept from him confirming the money recieved by him? I found it quite strange about him not providing a reciept. Can he be sued with just the bank account details?

MOreover,most consultant these days are charging a hefty 'security deposit' for filling H1B. Is there any reliable consultant out there who doesnt charge filing fees and willing to file even in this economy? This forum might not be for such discussions, but it would help tremendously if someone could guide me on this.

Not sure if you can sue him based on it but your canceled check/image is your receipt.
 
You can have some employer file for you whether with or without deposit, but it is not likely to be approved (even if it gets selected in the lottery) unless the employer can prove that there is a real job waiting. There are so many people out of status on bench these days, do you want to be in that situation?

Your wife did a mistake of giving money for H1 filing. You should ask the money back from him.
