H1b revoked

Hi,

My employer said my H1 has been revoked as he sent to USCIS wihtout informing me. He told me 2 weeks prior my last day here. Is it fair for him to so? Is there a way I can find out if he has really revoked H1, because I heard the employer has to pay to do something like that. Moreover he is not even paying for my flight back.

Thanks

Yes, two weeks notice is standard practice. He has to provide you and your family a ticket to your home country. You can complain to DOL using for WH4 for not giving you flight ticket.

why the employer need to provide ticket to Family? Employer did not call the Family to US.

maybe not, but they have to provide at least his ticket.

I don't think employer has to pay anything to revoke H1B petition apart from cost of mailing the letter (42c+). Why would the employer lie about it anyway?

What is fair or not fair is relative. So far your employer has not done anything illegal, yet. However your return ticket should be paid for.

You just lost your job, buddy. Really feel sorry for you. But, don't lose heart over H1, if another employer wants to hire you, they can file a petition anytime and you will not be subject to cap unless you have been in H1 status for 6 years already.
