H1B Quota issues

Mr.Khanna,

In view of your clarifications dated March 14(apparently from USCIS),can you please answer this question?

Can a doctor(resident) currently on H1B visa in an exempt program start employment in private practice on H1B without subject to cap?

(This is after all someone who has held valid H1 status since the last three years without a break)

If you received waiver through Conrad 30, I would argue you are cap-exempt. Otherwise, no.
