H1B needs to extend, but I misplaced my I-94

My H1B (6th year) will expire and I need to extend it by recapturing the days I was overseas. My lawyer requires copy of my latest I-94. Now the problem is I misplaced it, but I remember my latest I-94 # and my last entry date to USA.

My question is: Does I-94 really require to file extension? Filing I94 replacement is not an option since it takes long time.

Somebody please advise.
 
your I 94 is the "ONLY" proof of your status(whether you are in status or out of status) in US. Based on the I94 only your H1 will get extended. You must apply for replacement immediatley, based on that you can extend your H1.

greatguru: I called USCIS and they said filing I94 replacement will take up to 90 days.

Now when I look my I797, which was issued few years ago, there is I94 # in it with the date valid as of today. Can I file extension using I94 copy that is in my I797? It has validity date until 10/2009.

Is it ok to file extension without physical copy of I-94 providing that I know the number + last entry date?

I am assuming USCIS should be able to validate this number in their system, but I'm afraid that it is not their burden to check and will just reject my petition due to lack of I-94 physical copy? If so, can I refile?
