I just got laid off yesterday July 30th 2024. I have an H1B and my I-140 was approved back in 2022.
I am in the process of applying for new jobs, and my 60 day grace period ends on September 28th 2024. My current H1B is valid till November 19th 2025.
My husband has his H1B. If I change status to H4 under him, can I switch to H1B if the new employer files a transfer after the 60 days?
Should we apply for H4 anyway? We are in the California USCIS center which has a 3.5month processing time as of today.
What immediate steps should we take apart from continuing the job search? Do we have any other options?
If this helps in any way, we have a 2yo baby who was born in USA and is a US citizen.
