H1B Extention timeframe, Urgent, pls. help.

Hello,

My 1st 3 yrs H1B expiring on Sep'08. Because of some personal reason I am travelling to India in April and coming back after couple of months.

My questions are:

1) Can I renew my H1B for another 3 years during this visit? As I dont know it is ok to renew before September month itshelf.

2) If I renew it in month of April then is it get valid from April'08 + 3 years or Sept'08 + years?

3) If I have to stay more than 6 or 7 months in India before coming back to USA, is that get any effect on H1B status?

1> You can apply for H1 extension 6 months in advance (from the date when H1 is expiring).
2> Not sure, but it should be Sept + 3.
3> Should not be an issue, but you will need to get the H1 stamped before coming to US. There "may" be some questioning at the time of stamping as to why you were out of the US for so long.

Another question.

If I apply before 6 months and if it get renewed. How soon I can go for Visa stamping? I mean is there any duration before then only I can go for new extention stamping?

Somebody told me that you can go only 60 days in advance of your visa expiry. Is that true?

I do not know about this 60 days limit. I think you can go even 4 months in advance, but not sure.
