H1B extension & H4 stamping

Hello,

I am going to India for my marriage in the month of October and will be back by November. My current H1B visa is valid up to January 4th 2004. My company filed my H1B extension papers on July 23rd. I am leaving on October 25th.
If I don't get my extension papers before that, is that ok to travel with my current visa? (which is valid only upto Jan 2004)

I want to bring my wife on H4 visa. If I do not get my extension papers before I am leaving, She has to apply for H4 visa using my current H1B visa (valid up to Jan 4th 2004).
Since there is only two months in my current visa, is there any prossibility of rejection?
If she get the visa without rejection, do i need to extend that after I get my extension(ie after Jan 2004)?
What is the procedure for H4 extension?
Do I need to go thro my company or any lawer for extension?
OR
Can I wait for my extension and then apply for H4?

She applied for her passport. she will get at any time. But I want to fix an appointment with US consulate chennai india before that. Do I need her passport details to fix an appointment?

------- Its obsolutely ok to travel with ur visa and reenter with your spouse (h4 ) even though u have only 1+ months of validity on ur visa.....

------NO... they will ask how long u want to stay.... say 2 months or till end of visa... thats all

What is the procedure for H4 extension?

----you have to fill I539 form and your latest paystubs, and employment continuation letter, $140 fee thats all .....
Well.... i did on my own for H4..... but its up to u....


Can I wait for my extension and then apply for H4?

----instead of wasting money and time two times for H4, change -----your application for H1 extension to Premium Processing...
----You should get it in 15 business days... if NO RFE on it.

1) My spouse just applied for the passport. I want to fix an appointment with consultate now. Can I fix the appointment without her passport?

2) My company applied for the H1B extension in July. My current H1B is valid upto jan 2004. If I fix the appointment for getting H4 with my current H1B, can I change the H1B details (from my current to new) incase I received my new H1B before the appointment date?
OR Do I need to fix a new appointment if I change my H1B details?

--- you can fix your appointment for your H1 Visa stamp if you need, you should not fix appointment for spouse if she does not have PP in her hands. Once she gets PP then she should go to consulate or interview

-------If you receive the new H1B approval use that H1 approval for your H1 stamp and your spouse H4 stamp, if your new H1 is not approved and you don’t get H1 approval notice in hand then you have to get Visa based on current H1 status that is up to jan2004, remember if you don’t get new H1 approval before you leave for India then your spouse may get H4 validity up to Jan2004 only and her I-94 will be valid till Jan 2004, once she reaches US immediately file for her H4 extension by form I-539 once you get your H1 extension approval

How did U apply for the p/p and when do U anticipate the p/p coming in?
