I got a letter today from USCIS regarding my daughter's H4, it says

As a dependent, the applicant's classification is subject to the principal alincipal alien's status. Since the nonimmigrant visa petition filed on behalf of the principal alien, seeking calssification under section 101(a)(15)(H)(i)(b) of the act, has been denied, the applicant does not qualify for the request extention of status

I haven't got any letter yet, but my guess is my H1-B extention has bee denied.
My 485 is pending, and I have my EAD, I guess I can still work, the question is how the denial for my H1B will impact on my GC?

thanks very mcuh for your help!

thanks!

when was you LC filed ? When was your I-140 filed and approved ? What is EB category and which country you are from ?
how long have you been on H1 ?

Wow. that is very strange. Can you provide your details. How many years have you been on h1. when was I140 approved. IF you have your EAD, then why did they deny your H1 extension. Was it for 3 year extension, Also did they wrote a letter to you giving you reasons as to why they denied it. Which center processed your case. Was it in California.

Please provide details. Do you have any kind of record with the law. Have you ever been out of status. If allthis is not true, then you can file Motion to re open. they did that to me last year, and I filed a MTR and it got approved. you an send me private message if you like.

Thanks!

I am from China

I am in good standing, never out of status, never have problem with law.
this is my 9th year on H1, my I140 was approved 11/2004. I have my EAD.
I am EB2, the extension is 1 year.

Thanks!
Zhou

You should be able to get 1 year extension. Not sure about 3 years as I don't know your PD.

Anyway, answering your question, this denial won't affect GC process.
