Hi,

I have a question related to my I-94 expiration date. Any suggestions/comments/help are highly appreciated in this regards:

Questions: My I-94 is getting expired on Sep 09 but I got my H1 transferred to company B and received an I-797A approval with date till Oct 2011. The visa stamp (with company A) is also getting expired on Sep 09.

1. Do I have to leave the country before Sep 09 and come back again for new date on I-94

2. Will I be out of status after Sep 09 when my I-94 expires.

3. Can I go to Canada and come back to get a new i-94 or do I have to goto India, my home country, for this.

Thanks and Regards,
Ako

-------------------with Comany B H1 transfer approval notice that is approved till Oct 2011 look at the lower right side of the approval notice you may have I-94 attached till 2011(this is not like WHITE I-94 that one gets at POE it has same color of approval notice.)
The visa stamp (with company A) is also getting expired on Sep 09.

1. Do I have to leave the country before Sep 09 and come back again for new date on I-94

Thank you for your reply.

Regarding the new approval, the I-94 does not have a date on right hand side but on the left hand side which is for personal use. The right hand side I-94 has a number at the top that is same as the number on original I-94 (the original I-94 expiring Sep 09).

I am a bit confused, how to interpret this. Do I have to submit this new I-94 at the Port of Exit when I leave. I will appreciate any help.

it means you have I-94 attached with your H1 approval notice till 2011. you can stay and work on H1 till I-94 expiry date. make the copy of H1 approval notice that has I-94 attached (front and back) and keep it with your immigration related documents. always make the copy of I-94(front and Back) and keep for records.
When departing US then one need to surrender ALL the I-94 at airline counter.
