My 3 yr H1B visa is expiring in Dec-04. My employer is alredy collected all documents for filing the extension.
(I am told that there is rule that they cannot apply before 6 months of visa expiry for extension. So had to wait till june-04. ).
So far i havent left US to get my stamping done. I plan to travel to India in Sept-04 to get my stamping. Would i face any problems if,
1) I do not get my extension approval letter before i leave to India.
2) Could they reject my application for stamping if the visa is expiring in Dec-04. (since it is just 4 months from expiry).
3) Incase i dont receive the ext. letter before i leave for India, then should i mention that H1B ext. papers have already been filed?
I appreciate any and all feedback.
