H1B expiry due to delay in entry in US.

I hold H1B visa,
Start date: 8 Dec 2005
Expiry date: 1 Oct 2008

I have not entered US till now. Can someone confirm that my visa is still valid or not.

Someone told me that there is a possibility my visa may be treated against the H1 quota due to the time spent outside the US...

If your employer still hired you and did not cancelled H1, H1 is still valid.
