H1B Application Details

Hi

I am currently on an F1 visa, with an OPT work authorization ending Jan 2005. My employer will be applying for my H1B this month. However, I need to go to India in August 2004 for my marriage (hence cannot be postponed).So, a couple of questions:
1) If I apply rite now, do I get an approval before Oct 1 2004 (say in case premium processing is done), or is all processing started and done after Oct 1 2004?
2) If processing is done after Oct 1 2004, is it OK fo rme to leave the US in August 2004, and come back September 2004, since I currently am on F1? Does the pending application affect this?
3) If I get approved before Oct 1, is it still ok for me to leave US in August 2004 and come back on my F1 status?
This is extremely urgent.

1. With PP you can get the approval (with start date Oct 1) before august.
2. If you leave when the F to H is still pending- your application will be considered abandoned
3. You should not come back in F1. You have to come back in H1 with a stamp that you can get at the US consulate- which means that you can only enter USA in October.
 
Hi my company is ready to file H1b for one of my friend in India.

My friend applied for passport before a month and it will take 3 month to get it.

but can my company file for h1b without copy of Passport ? I think it need copy of PP and I-94 if person in US already, otherwise one need when he/she go for Visa. I asked my company and they said they need copy of PP to file it?
