H1B and H4

Any help with regards to the question below would be greatly
appreciated.

My H4 approval notice was filed on Aug 28, 2006 and the notice date
was Dec 15, 2006. It is valid till Sep 2008.

An H1B was filed on my behalf on Aug 12, 2005 and the notice date
was Nov 2 2006. It is valid until Sep 2008 also. I have not been
able to start working yet so therefore I have not received any pay
stubs.

My question is this: My wife and I are going to Canada to get her
H1B and my H4 revalidated. Can I still get my H4 stamped eventhough
I have an existing H1B approved? Would the Toronto consulate have an issue with this?

If you have info on this, I would be extremely grateful. Also, if
you happen to know a website that has the answer to this query,
please post a link.

Thanks again!

Approved H1 and H4 visa stamp are 2 different matters. You can get H4 stamp as long as you are qualified for H4.

I'm sorry. I did not quite follow your response. Are you saying that it is ok for me to have both and H1B and H4 approved? If my H4 was the most recent approved, does that invalidate my approved H1B?

Thanks for your response!

Later approval of H4 status overrides H1 status in the US, but your question was whether H4 stamping will invalidate H1 approval, where the answer is, No, H4 stamping won't invalidate H1 approval. However, if you have H1 stamp in your passsport, consulate officer may invalidate your H1 stamp upon H4 stamping.
