H1b and H4 suggestions

Hello,

My visa status is H1b. I am getting married in march 2007 in india. She is from india. Meanwhile I want to apply H1b for my fiance in april 2007. she already got the job offer and company is ready to apply for her h1b in april 2007. If I getting married in march 2007 can I bring her on H4 while H1b in process? After she comes here on H4 in the mean while if her H1b got approved can she change her visa without any problem? And she is also having B1 visit visa for 10 years multiple entry. I know I have time but i want to plan in advance. I really need your suggestions.

-------- how YOU can apply H1? US employer has to file H1 petition

----------- you can bring her on H4 in March and then let the employer file H4 to H1 COS in April 2007. or she can wait for H1 approval notice(may take 3-4 months after petition is filed) and then get H1 visa stamp and enter US on H1 status.

I mean US employer is ready to apply for her H1b.

Can she come to US in May or June on H4 in the meanwhile apply for h1b in april. will it be any problem?

----------------------She is in India when US employer file her H1 petition with USCIS and while her H1 petition is pending with USCIS if she enters US on H4 visa status then she has to go out of US to get H1 Visa stamped after her H1 is approved by USCIS and need to enter on H1 status to work.

** why not to file her H1 by premium processing in April and her H1 can be approved in 15-25 days and then employer sends her H1 approval and she gets H1 visa stamp and then enter US on H1 status.(visa stamping wait may be problem check the wait times of US consulates in India for visa stamping.

*** if she comes to US on H4 in April, May then better employer file her COS from H4 to H1.
