H1B and gap in the cap--Please help!!!

Hi
Can someone provide me some info on possible problems if multiple H1Bs are filed for the same person by same/different companies in the same time frame?
Also, my OPT expires on 31st August, and H1B become valid from October 1st. What are my options?

I shall be grateful for any advise/help.

Go back to home country, Ask your employer to send the approval notice to your home country for visa stamping, come back 1 Oct 2005, if you are not eligible for grace period, like last year INS granted to all F1 students. (fill the gab)

Iam in a similar situation.
My Opt ends on may. H1 will be filed by my employer in 20 K or 65K.
Can I go to India and ask my employer to send the H1 approval noice to India .
Do I need to go the Indian embassy for that purpose.

Some of my freinds said that if H1 is filed and you leave the country, it is abandoning the H1 application. Is it true?

Esesbee,

I think you will be fine since under your F1 you are granted a 60 day grace period after OPT runs out, and since yours ends up on 31st August you will be able to stay in the country until H1 becomes valid. Important, you cannot work or be under payroll during that period of time!! Anyways, better consult a lawyer for further information.
