My H1B was renewed in 2004 and I got an approved I-797 till 2007. At that time, my wife's H4 was also extended and I-797 approved till 2007.

In 2006, my work location changed (though with the same company) and my exployer filed an H1B amendment and I got a new I797 (in 2006) valid till 2007.

At the time of filing the H1 amendment, my company did not file anything for my wife's H4. My question is that did my H1 amendment invalidate my wife's H4 approval (I-797 received in 2004 which is valid till 2007) and is there a need to file something for my wife's H4 as well at the time my H1 amendment was filed?

FYI - The visa stamps (H1 and H4) on our passports expired in 2004.

Hi Djb. Did you get an answer to your question. I am in the same situation now. My company is filing an amendment for myself, but what should I do for my wife's H4 status?

Thanks!
Akshay

Hello Djb: I may be changing work location to a different state with the same company. Do you know if I can move before getting the new I-797 and also could you please let me know how long it took you to get the approval notice and the final I-797?

I will greatly appreciate your response.

Thanks!

If your wife's H4, I 94 is valid, and it renewed along with your h1, then H1 amendments (other than stay dates) does not matter and it will not affect h4.
