H1B abuse

I couldnt find a better place to post but here it is.

My company laid me off 2 months ago and promised me a severence but is now refusing to pay it to me. They also do not want me to find a new H1B sponsor otherwise they will cancel my green card process(applied in Feb 2003) and report to INS that I am now laid off. They want me to be on their payroll but on unpaid vacation until I find a new project for myself. Once I find a project they will take a good cut out of my payrate from my client.

Can I take an action against my employer?
I am fed up of this harassment. I want to sure them and I dont care about my GC.

my H1B sponsor paid for my travel to the USA 4 years ago. Now if they lay me off, are they supposed to arrange my travel back to my home country?

Please advice. what can I do.

If you dont care for your GC then switch your h1 to new employer and file a complaint against your current employer with DOL.
There is a h1-B complaint form on DOL website. Just fill it out and fax it to the DOL office located in state where your current employer have buisness.

Yes, they have obligation to pay your transportation back to your home.
