H1B 7th year extension while BEC pending

VISA stamping question

hello,
i do have a visa till may 2006 and i am in my 7th year applied for LC and waiting for approval since may 2002. now the questions i am planing to visit my home country since i don't have a stamp on my passport i was thinking for getting it done during the visit. my friend told me that they are not stamping thru the travel agent instead we have to visit the consulate and get it stamped is this true. any of had this problem recently....please post your comments.

also if some one goes to a emergencty trip what we need to do if we don't have a appointment in the consulate...

You do have to visit the consulate for visa stamping if your current visa is expired while you are travelling outside US. If it is an emergency trip then you can get it stamped from either Canada or Mexico where you can get appointments rather quickly than your home country.

You can also try contacting the embassy to take an emergency appointment in case all the dates are booked. They do keep emergency slots open for urgent appointments.

Just to let you know...
I talked to an INS officer last week. She told me that Nebraska Office is processing H extensions from July 2005. She told me that I only need to pay $185 for i-129 form and $195 (I think) to get H-4. If you follow the instructions on the form you dont need to pay fees to a lawyer. The first time I get my H1 visa, I did everything by myself by reading the information in the forms and calling INS directly for questions... I think it is ridiculous to pay 3000 or even 1000 dollars to a lawyer. It is so simple... just follow the instruction in the form.

If you are planning to travel outside of the Country... be carefull. You will need to update your visa with the extension form provided by INS in the US consulate in YOUR country. Several INS officers told me this. That costs money depending on the Country... for me, it is 600 dollars for the application on the visa and 100 dollars per year of the visa. So if I want an extension of 3 years I need to pay 900 dollars in the consulate in order to enter to the US again. H4 need to pay 100 for the application plus 100 dolares per year... As I said... It depends on which country are you from.

My attorney filed H1B 7th yr ext with GC SWA copy? ( with out screen shot ). What are the chances or approval?

100%... :D

The priority date is the most important thing in the whole GC process which will denoted in your SWA copy. You should be in good shape !!

My lawyer did the same but I am not worried. These guys know what they're doing. Im sure that is acceptable as well. I trust my lawyer on that.

I am in my 2nd extension beyond 6 years (basically 8th year) H1B, still no signs of LC approval. I do not have visa stamp on my passport.

Recent news had indicated that there is a clause for 'Returning Workers' - candidates returing from US and with previously stamped H1B visa. Such candidates would get prioritized appointments.

Try http://www.ttsvisas.com for appointments before end of Sept 2005. Other helpful site would be http://chennai.usconsulate.gov/visainfo.html and http://www.immihelp.com

Agree with other readers on forum. I am in similar situation, I got my H1B extension using the SWA copy (no screen shot - I still do not know where my case is - MD state 05/31/2002 - no regional/no 45 day letter).

Question

If somebody is in 8th year of extension and LC & I-140 approved ..not able to file I-485 because of retrogression. Can he change job using H1-B transfer in 8th year and then apply LC/I-140 and then I-485 from new employer using the old PD .

But in the mean time ( after filing H1b 7th yr with SWA copy) my GC case was closed in error ( anyway, we are trying to reopen the GC) Does it affect H1B 7th year approval?

As long as INS is being informed by DOL that your case is being re-opened then I don't see any reason why there should be any problem in the approval... However you have to keep your lawyer on his toes to make sure all the paper work from your end are submitted properly.

criteria for 7th yr extn

I am not talking about 365 pending rule.
How about if one gets a PERM approved labor (say in 3-4 months) in 6th yr and then file 140. Is he/she eligible for 7th yr extnsion?
 
Interesting. Which service center was it sent to? I sent mine in mid Aug and am still waiting. Mine was sent to NSC.

Mine went to california Laguna niguel service center , I filed in sept 6 th and they aproved it on sept 30th, I could not believe it !!!

Nowadays INS is approving H1B extensions within 30 days since their work load is less... :)

Wish BEC's would speed up things instead of data entrying forever... :mad:
