H1 visa validity after resignation

Hi,

I am having a valid H1 for next two years. I have been to US on this H1 and right now I have come back to India.

If I resign from my current company (who's name is there on my H1), will my H1 be still valid? Will I be able to go to US on this H1 ?

Thanks,
Darshil

No

If you have not changed you H1B before resigning, and your employer cancelled your H1, you will be denied entry (at POE). The system will show your visa is revoked by your previous employer.

Still at risk

At POE, if the officer verify the employer (usually they call employer) and employer says you are no more employee of that company, you are in trouble.

What is the case if i am in india and anothe employee file for transfer of H1B to new company. Then are there chances of rejecting the transfer due to non provsion of earlier employee details like payslips and taxes paid. Please advise as i have resgined and planning to go back to enable my H1 B transfer smoothly.

Hi,
I am also in same situation. This post looks very old. I was in US till last April (April 2012) I have a valid H1B. Now I resigned from my current company (H1B Visa with this comp) . One of the US company ready to transfer my Visa after 6 months. My H1B visa valid till march 2014. I will be moving out from my current company in a month time, So after 6 months if the US company try for Visa transfer , will I get the Visa..

Please please .. help me on this.. Your help really appreciable.
