What was your previous status F1 or H4?

Visa Stamping

I was on a H4 visa since September 2000 and I converted to F1 visa in March 2005. I'm currently on OPT and have applied for my H1 starting October. My visa in the passport expired in April 2002 and I have not had a valid visa stamped in my passport since then, however i have all my I94 in hand. I have to travel to India this November and was wondering where to get my visa stamped? Should I go to Canada or India? Also, will there be any problems in Canada as my visa in the passport expired 3.5 years back.

Can someone please advise me on this one?

Thanks

Canada is the best option for those present in the U.S. as there is a long wait at U.S. embassies in India.

No, as long as your are legally present in U.S. Visa stamp in the passport is necessary only for re-entry purposes.

Can someone please advise me on this one?

Thanks

Yes.

As great guru asked, tips require information about your previous status in U.S.
thanks

sorry about incomplete info

i was on F1 status....was workin on OPT, now got my H1 approved

my case is very similar to crramya. But i wasnt on H4 anytime. But i was on F1->H1->F1-> now back to H1
and yes my visa has been expired for 4-5yrs now:P

but as far as i remember....never got out of status anytime....expect for a little while during the transfer from f1 to h1 the first time....but that was waiting for the approval...so i was still legal there.

anyway.....i too heard that it is crazy out in India...trying to get an appointment. SO....would it be safe to get it done in canada?

I just found out some of my friends have gotten there H1 stamped in canada for the first time. But ofcourse they didnt go thru the many changes like i went...so i guess it was not a problem for them.
