H1 Visa Extension..pls help

Hi,

I am applying for my H1 visa extn for the same company for 3 more years. My present H1 expires on 30th Oct 2005.
My lawyer told me it will take 5-6 months (approx. Dec) from now on to get the new approval notice with the new I-94.
Do I have to leave United States before 30th Oct 2005?

Is there any grace period for this?

Please advise.

------------- if filied with premium processing it will take 15-20 days. you can file the H1 extension Now
Do I have to leave United States before 30th Oct 2005?

You are applying ahead of time and your extension should be approved before Oct. Anyway, if you do not get the extension approved by Oct, still you do not need to leave the US. If your H1 extension is applied and is pending and your current H1 expires, you can still keep working for your current employer for X number of days after current H1 expires. I think X is 180 or 240 days, not sure about the number of days, but definitely there is a grace period. Check with your lawyer also.
