H1 visa and Advance Parole

Hi all,

I sucessfully got H1 stamp(extension) from madras via drop box on dec 9th. got married on dec 17th. at the POE the immigration officer somwhow found that i have advance paROLE AND EAD from I-485 and has paroled me for one year i,e dec29th 2003 to dec29th 2004.
he further said i cannot have ead and h1b same time....he was rude and verbally said he will canel my h1b.

my question:

My wife hasn't applied for H4 yet. HOw can my wife enter usa? i am still with same company who sponsored my h1b and also Greencard.

Does entering usa on Advance Parole, cancel H1 automatically ?

You should have talked to a supervisor and stood up for your rights. You can still go to Port Of Entry and get a new I94 with H1 based I94. It will be better if you did that .
Which port of entry is this?
 
H1 vs AP

POE: NEWARK

I reside in IL, My flight to chicago from BOMBAY was cancelled so I had to come to NEWARK AND take connecting flight to CHICAGO.

Now that i am in IL, is there anyway to get corrected I-94?

Seniors, pls help.
 
My wife is attending H4 interview on Jan 20. Can she come to usa on H4( my i-94 was stamped as allowd under Advance Parole). I will wih same company who sponsored my H1. Is my H1 still valid
? Would my wife face any problems at POE ?

what are options at my end ?
Can I leave usa and reenter as H1 and my wife on H4 ?

If she has valid H4 Visa she can enter without any problem. Visa is Visa to enter US without any problem.

Your case is very rude, you have to talk to his supervisor, AOS (GC) is for future employment not for current employment, if you are not using your EAD for the work and using H1B at work you have to have H1 Visa and enter US on H1 without AP and EAD. If the immegration officer don't know that you have to explain him or ask him to call his supervisor.

There is no ware specified as you can't hold H1B and Parole visa. You can have any number and types of visas and you can use it which is necessary....Now your H1B term is over and ask your spouse join immediately so that she will not get any trouble.

Once she landed file AOS for her and take EAD and AP for her also so that when you want to visit again you have AP.

iam int he same situation as yours. let me know if your wife will be
able to come to US without any problem.


I also got married on AP and got back to US.
now iam now planning to go back to H1 so i can sponser my wife for H4.

any one know of any issues with this process???
