H1 Validity

Hi,
I got my H1 from 'X' employer in November 2004 and I came to US for the first time in May 2005 for about 4 weeks and returned back to Germany. I came to US again in December 2006 on the same H1. Then I transferred my H1 to 'Y' employer without working at all with 'X' employer. Can anyone please let me know whether the period in which I was not in US will be counted towards my 6 year period of H1 or not?

You can file a amendment to "recapture" the time you didn't send in the US. Talk to an experienced attorney.

NO...you have to be physically present in the US to tick the H1 clock.
