H1 Transfer

Hi,

Any help with the query would be immensely appreciated.

I was holding H1 visa that is valid till oct 10, 2006. My company changed my status from H1 to L1. I am currently holding L1 petition with a new I-94 that has an expiry date of 2008.

Recently one of my friend told me that I can transfer my H1 that is valid till Oct 10 ,2006 to his company. I didn't clearly understand how that was possible.

Could any one explain if it is possible and are there any legal issues in doing so. Remember that I am holding L1 petition with a new I-94 valid till 2008.

Let me ask you my question again...

I was on H1B from Company A and the same company A converted my H1B to L1A Visa. The L1A petiton has an I-94 attached and is valid till 2008.

My H1B is valid till Oct 10, 2006. Is it possible for me to transfer my H1B to another company B.

If yes, then what will happen to L1A visa?

Will I Have to joint the Company B immediately on receiving the recepit of transfer? How long Can I work for company A on L1A status.
 
You can transfer H1, but you can not start working for H1 sponsor until transfer is approved. Once H1 is approved with change of status, your L1A visa is valid, but L1A status got void so that you are not eligible to work for L1A company.

Could you verify this answer:

If your L1 was for less than a year, you can go back on H1 status and transfer to another employer. Let me know if it is true?
 
it does not matter how long you are on L1. YOu can come back as long as L1+H1 period is less than 6 years.
YOu still need to change status from L1 to H1.
 
Follow up on a similar issue

I'm on a H1 visa and have about 8 months left to complete my 6 years. I work a major Indian company and recently joined them (3 months back). Could I convert my H1 to L1? Would the 6 year limitation still apply? All I need is a valid status to continue my status for another 6 months after my H1 expires, by which time, I would be having my EAD thru my spouse.

GotPR you are the pro, guide me.

Even though you satisfy all the L1 requirement and you can file for L1, 6 year limit is still applied and you can not stay in the US as L1 beyond 6 years.

What do you mean you are waining for EAD through spouse ? Did your spouse file for GC under H1 or so ? If so, you are eligible to dependent visa after 6 years.
