H1 transfer

I am currently on h1b1 with company A and I got a new job offer from company B today. I want company B to apply for H1b1 suggesting that the new H1 be effective one month from now, so that I can continue working for company A till the effective date of new H1b1 with company B.

1. Is the above plan legally viable?

2. In case, the H1 transfer is not approved, will I be able to continue working for company A?

3. In case, the H1 transfer is not approved, will company A get this information at any point of time? If yes, then when does company A come to know?

4. Am I legally required to inform company A about company B and the procedures that they are taking at any point of time bfore I leave?

1. Yes
2. yes
3. I dont see how or why
4. If it is in the contract you and A signed you have to, INS does not impose any such rule.

H1 transfer. New question

Thanks a lot for your first reply. If I follow the plan below, I may end up holding two H1 simultaneously for certain period of time, and I am assuming I have the option to choose any one.

1. Is this a correct assumption?

2. When INS approves the second H1, do they, by default, make any one of them a part time job? Or is it like I can choose to have both H1 approved as full time jobs and later choose to work as full time for any one of them?

3. May I know your personal legal crendetials in brief?

Thanks again.
