Hi,

I have another 1.2 years left in my H1B. My client has offered me to join them directly and I am very interested in the offer. They agreed to do Premium processing of my H1. But they might do my GC in non-rir. I got 2 month time left before my last 365 days to start. Will I be able to do premium processing and file my GC before Jan 2005. Please let me know.

Thank you

--let them file H1 transfer with premium

ask them to file LC for you ASAP

---- H1 transfer is diffrent petition and filin LC for GC is diffrent the comany can file LC any time. if they file H1 trough PP then the lawyer will get H1 transfer approved in 15-20 days and employer lawyer should file your LC ASAP so that it hits 365 pending before you hit 6 years. LC filing date should hit 365 days pending at least 10-15 days before your 6 year I-94 expires becase you can file 7th year H1 extension when you have Valid H1 and valid I-94( make sure your 7th year H1 extension reaches USCIS BEFORE your I-94 expires and lawyer should submit the evidence of LC filing and pending more than 365 days with DOL)

** if your present employer has filed LC for you and you expect that it may be approved in 5-6 months, then better stick with him becase that LC will be having early PD and once LC approved file I-140, I-485, EAD AP.
Please let me know.

Thank you

Hi Ginnu,

I'm in similar situation like SPLCASE.

I was in US for 4.6 years on L1 thru an Indian company.
Resigned my Indian employer and came to US on H1_B on 26th of November thru company A. My H1_B is going to expire on 19th APRIL 2006.

My client has offered me to join them directly and I am very interested in the offer. So, we are going to apply my H1_B transfer.
Should I wait until I get 1 or 2 pay stubs from company A before I apply for H1 transfer??

As my H1 is going to expire on 19th APR 2006, Before what date my client should apply for my GC.

Please help me.

Prasad.
