H1 transfer to a new company while RFE pending

Hi Guys,

I would greatly appreciate if any of you can share your experience with this problem.I got a query, asking W2 form while H1 transfer(company A to B) and its looks somewhat difficult to get the transfer approved.If I apply for a transfer(company B to C) based on the receipt notice at a different INS center what are the chances of getting it approved.

It might get approved, however they will find out about the RFE based on the current receipt and are so likely to generate another RFE. But you might get lucky...
 
Thanks for replying jaxen.My I94 is valid till jan 01 2004.So I'm assuming if my H1 petition with company B(currently pending with RFE) is approved without an extended I94, then I can stay till 1/1/2004 and afterwards I need to go out of the country and get the new visa stamp and I94.Now if I apply for a H1 transfer to a company C before the I94 is expired and with approved H1 petition from company B(no I-94)what are the chances of getting approved H1 with extended I94?

If you get your H1 approved from Company B without I-94 attached on it You cannot work on that H1 and would be required to go back to India to get it stamped from Consulate on your Passport.


Also you cannot apply for H1 transfer to Company C from Company B with H1 approved without I-94 attached to it
