H1 Transfer RFE

Hello All,

Need some guidance for my case here. I applied for a H1 transfer and joined the company. I received an RFE on my H1 from CSC to verify that I have verifed job contract for the rest of the visa validity period. They have asked for Work Orders, Duties etc.

1) Is this a regular RFE? Can anyone please suggest how to go about? I have the contract till beginning of 2006 and that's when my Visa term expires.

2) How Long can I wait before another company can file for my H1 transfer with the H1 Receipt of the current company?

3) In case the INS rejects the current H1, can I still apply for H1 Transfer with the H1 receipt that I have? If so, How soon should I apply

I have Regular payslips for all this period. So Payslips will not be an issue.

I would really appreciate any help...Thanks a lot!
 
1. Does the company have a track record ?
2. You have to do it immediately- within 30 days from RFE
is a recommendation some lawyers give
3. Although You will be out of status, you can still apply thru another company
 
Hi Jaxen. Thanks much for your response.

I was thinking of going back to my old company. My H1 and I94 with the old company is valid till 2006. I would like to wait for this H1 to get approved. If the H1 is not approved, I was thinking of going back to my old employer. Is this a good idea?

you should have my PM response. Unless you have been with the new company less than 60 days (or your paystub with old company is within 60 days) you cannot just like that go back to old comapny, need another transfer.

Hi, I got the similar RFE. Have you responded yet to the RFE ? Could you post more details.
