Hello All,

Need some guidance for my case here. I applied for a H1 transfer and joined the company. I received an RFE on my H1 from CSC to verify that I have verifed job contract for the rest of the visa validity period. They have asked for Work Orders, Duties etc.

1) Is this a regular RFE? Can anyone please suggest how to go about? I have the contract till beginning of 2006 and that's when my Visa term expires.

2) How Long can I wait before another company can file for my H1 transfer with the H1 Receipt of the current company?

3) In case the INS rejects the current H1, can I still apply for H1 Transfer with the H1 receipt that I have? If so, How soon should I apply

I have Regular payslips for all this period. So Payslips will not be an issue.

I would really appreciate any help...Thanks a lot!

---your lawyer should reply to RFE, Job duties must be wriiten some time the ask for breakdown of duties, if your lawyer is good then i dont see any problem if he reply to RFE
2) How Long can I wait before another company can file for my H1 transfer with the H1 Receipt of the current company?
---- first let your this H1 get transfred once you have this H1 transfer approved in hand then only file other H1 transfer?? Why are you jumping employers???
3) In case the INS rejects the current H1, can I still apply for H1 Transfer with the H1 receipt that I have? If so, How soon should I apply
-----it depends on the reason for rejections, better wait after sending the reply to RFE I think they will approve your filed H1 transfer

Hi Ginnu,

Thanks much for your response.

I am not applying for a H1 transfer, but am thinking of going back to my old company as my H1 and I94 with the old one is valid till 2006. Is this possible? Do I need to apply for a transfer again with the old company.

I just want to be on the safe side.

Please suggest.

Thanks a lot!
