Hi

CASE OF H1 TRANSFER. THERE IS AN RFE TO PROVE STATUS

I QUIT COMPANY A AND JOINED COMPANY B ON MARCH 28TH . I DONOT HAVE SALARY STUB FOR MARCH BUT HAVE ALL OTHER PREVIOUSE STUBS.

I WAS ON LEAVE DURING MARCH LOOKING FOR PROJECTS
WHAT WOULD HAPPEN IN THIS KIND OF A CASE

HOW TO RESPOND TO THIS RFE

SOME ADVICE PLEASE

Provide more details like:
1) Post the details of your RFE
2) How long is your current H1B visa from Company A valid?
2) What is the expiry date on your I-94 card?
3) When did you file the H1B transfer to Company B?

Then only people can help you with their suggestions.

Here are the details

1) Post the details of your RFE
Document required to prove status for the month of March (as I dont have pay stub for this month)

2) How long is your current H1B visa from Company A valid?
Valid till sept 2006

2) What is the expiry date on your I-94 card?
September 2006

3) When did you file the H1B transfer to Company B?
During March, got the RFE on 19 th April

Ask your attorney to write to INS that you took vacation from March 1-28 before joining company B.
2) How long is your current H1B visa from Company A valid?

I have told my attorney that I was on leave(which I actually was) during which time I got this job and joined.

However, I would really appreciate if you can tell me
Am a bit worried.....

1) Are there chances of rejection ?? (If so, I have to go back !!!)

2) If not rejection, what would it be ??

If your attorney put to gether everything in a nice letter it will work definitely. It will not get rejected. You may not get change of status but get new H1 for that you may have to go back to your home counntry to stamp before start working. Your case I am quite +ve, it will get approved. But make sure your attorney does everything proper.

You can rejoin the comp A, there visa still valid.

I have one last question....

When you say i may have to go to home country, does it mean I need to go to consulate to get it stamped or is it that I just need to go out to get a new I94 (as my visa is still valid.)

If it is for only I94 can I go to any other country and get it stamped.

because INS decision is you are out of status. That is why they give new H1 instead of change of status

or is it that I just need to go out to get a new I94 (as my visa is still valid.)

H1 status

I can tell you to get a medical receipt or letter from doctor saying you were sick for sometime and under bed rest. That would help you to stay in bench during that time

Note; Im not a lawyer, consulting lawyer gives more perfection
