H1 transfer from Public institution to private company

Hi,

I know that the H1 Quata is full for the year 2006. I am being offered a job from the University which is not bound to the H1 Quata. They will process my H1 Visa. My question is that if I get H1B Visa then can I transfer that visa to a private companty which is bound to the H1B Quata.

Also I need to know how early after getting the H1B visa I can transfer to any private firm?
 
Once you are on an H1B, you can transfer anytime. Quotas do not apply to transfers, nor is there any set time required for each employer

In general, it's correct, but it is not correct in this particular case.
He will get cap-exempt H1 for university. Next time he transfer his H1 to private, it comes under quota.

The earliest to get cap-subject H1 is the next April.

Thanks. My university will take too much time to get me H1 close to 5-6 months. I dont know what should I do. I got several other offers (4-5) offers but all those are private companies and they can only apply for H1 in April and the H1 processing starts in October 2006. The problem is also that my OPT will be over in December 2006 so it will be extreme risk if I dont get H1 after applying in October. I guess I am stuck with the university.

Any advice
 
what's your current status ? OPT(F1) ??
you can look for job in Feb or March and apply for H1 in April with start date Oct 1 then most likely you get H1 before your OPT is over. If it's not approved before OPT is over, still not end of the world. You go out of the US and get H1 stamp and come back.

My OPT will start on 17th of December 2005. If I apply for H1 in April 2006 does that mean that I will get the H1 in October 2006 or does that mean that my application will start processing in October 2006.

They'll start processing once it is recieved in April , but the earliest date you can set to start working on H1 is Oct. 1. If H1 is approved by Oct. 1, you can work upon Oct 1(assuming you have other necessary stuffs such as SSN). If H1 approval got delayed beyond your start date for some reason, you need to wait til H1 is approved.
