Hi,
I have been on bench(without work ) for more than 3-4 months.
Now I have got a job where the company needs to do my H1 transfer, but since my latest pay stub is Jan 07 , will this affect my H1 Transfer filing? YES. You may have to produce 2-3 latest pay stubs to prove that you are in status. Will my visa still be approved ? YES. But extention of your status will be denied. Means you have to go out to get your visa stamped before starting with your new h1 sponser.
Thanks
Aryamommy
So does it mean u dont need pay stubs for your transfer and you could transfer the VISA the first month and go out of the country to get VISA stamped... please let me know if its possible to transfer H1B without pay stubs...
If you do not have paystub, technically you loose your h1 status. In this circumstances
Your H1 to H1 transfer and status extn will not be approved.(No I 94 issued along with your H1 approval)
Only H1 to H1, new visa will be approved.(But no quota issue)
If you want to work with new sponser you have to get new visa stamp in your PP and re -enter US with new I 94 card.
