H1 Transfer and H4 TO H1 COS

My wife and I have valid H1 and H4 visas till 2008 (I-94 also valid till 2008)and I was wondering if an attorney or anyone can assist me with our situation below:

1) This year my wife applied for a H1 and per the e-mail received from the USCIS it appears that her H1 has been approved. However we have no word on her change of status (COS). The attorney that filed her papers says that we will know this information only after we receive the final approval notice. In the mean time, is there any way to know for sure if her COS has been approved? I read somewhere that if the I-94 number listed on the e-mail matches the H4 I-94 number and if there is no consulate notification in the e-mail, then it means that the COS was approved. Is this true?

2) Also recently I was offered a job at another company and I have decided to get my H1 transferred. Should we get my wife's H4 transferred as well? OR is her H4 now cancelled because her H1 has been approved. What happens if her change of status is denied? Is she still on H1 or does her status revert back to H4?

Any and all help in this matter will be appreciated!

You can only confirm this one, as soon as, you recieve the h1 approval notice which has attachment of I 94 at the bottom of the original approval notice, untill then it is a guess work.

2) Also recently I was offered a job at another company and I have decided to get my H1 transferred. Should we get my wife's H4 transferred as well? (you can wait and see her H1 papers before transfering, transfer can done anytime before her h4/I94 expires) OR is her H4 now cancelled because her H1 has been approved. What happens if her change of status is denied? Is she still on H1 or does her status revert back to H4?

If her H4 to H1 COS is not approved she is still on H4 and continue to stay on H4 without any problem, if she wants to work for H1 then she must go outside US to get her visa stamped and come back to US to get new I 94 with caveat H1 to start working.

My wife's H1 was approved on 9/22 as was evident by the e-mail receoved from USCIS. However her attorney has not yet received her approval notice (I-797A with I-94) confirming her change of status. We called USCIS and were asked to wait for 30 days before asking for a duplicate. This is so frustrating!!! Is it possible that the notice was lost in transit? Does this happen a lot? What do we need to do for a duplicate? Can we ask that it be mailed to our home address instead of the attorneys office?

It occures very rarely, some time attorney office misplace it.
Original always comes to Attorney's office (because he is representing your company legally) but your company will get a courtesy copy of your H1 approval notice. Check your office. Or ask a duplicate copy through your attorney after 30 days have passed.
