H1 to H4 to H1

Hi,

My wife came to US in May, 2000 on H1B visa and after 3 years changed her status to H4 (on my H1B). Now if her H1B visa is filed, will she have to wait till Apri 01, 2004 (to get it in Oct, 2004) or can she get it right now (i.e. after having H1B visa for 3 years, will she come under H1B cap or not?)

I have said it before. Not under cap.
