H1 To Green Card In Simple Steps.

I am a non medico with a wife on H1 doing her Residency in VA Hospital in Im first year. Can u pls give me an idea how the things are going to work for us toward a green card. She is only in her first year is there any thing she has to do now or just complte her residency and exhaust her three years from H1 and the all will be done in the remainder 3 years of her H1.
I have read some detailed threads on waivers etc which i couldnt understand .
Can any one pls provide me with the details as to when and what is to be done step by step towards the green card process even though it may start after her complition of residency.

The first step: has the hospital agreed to sponsor her for a green card? She needs a sponsor. With employment-based green cards, it's usual for the employer to handle the application (though not, I believe,necessary, but I'm not a lawyer). She should be discussing this with them. Given the length of time it now takes to process green cards, the sooner in her H-1B that they start, the better. The H1-B is no guarantee of a green card--the hospital can only promise to sponsor her, not guarantee that she gets one.

Find a employer, may be a hospital or any other doctor who willing to open a clinic for her or offering job in his/her clinic as associates. It is not necessary that your present H1 sponser (VA Hospital) to file green card. Any one can start your wife's green card right away. Do not wait until 3 years to drain.

agree with the above post. I started my green card application within 6 months of obtaining my H-1. If you start now tha green card will be approved and status adjusted before your wife finishes residency. Then she can start working on a green card

partly true. you didn't specify your status? r u US citizen/PR? if on H4, then ...

1. An employment based (labor cert) GC will be Fastest for you guys.
BUT >>>> you CAN NOT start the process in FIRST year of Residency based on physician work. may be in 2nd year. Why???

When the labor cert application is filed with DOL (dept of labor), you should be eligible for it. Most states require 3 years' residency to be eligible for the the state medical license, some states want 2 years. So u need a *state* with appropriate medical license requirements and an *employer* willing to file your paperwork for the future GC job in that state.

2. VA hospital may be able to sponsor her under NIW category. But she will need to sign 5 years contract.
