H1- status

I was laid off last year by company A and within couple of months, got an offer from company B and filed for transfer in September 2001 at CSC. Received RFEs couple of times and employer appealed to the administration and it is still under the process (almost a year).

I have a few questions:

1. My old H1 and I94 expires this October. Can I stay in US even after it expires because the petition is under process?

2. What if I find another company and file new H1 before October. And if it is approved after October, will I be out of status from october to the date I get my new H1?

3. Or can I apply F-1 for spring semester? Do I have to file my papers before october?

Know this...

1. While an application is pending, you are in valid status. generally it used to be 240 days, I learn that it can be more than that. It all depends on the basis of the RFE(s)
2. No. Have copies of the receipts and RFE notices handy for life..

3. U can file F1 whenever you want...
