H1 stamping exp - disappointing - 221(g) - reason strange - please reply

Hi all,
I had a very disappointing experience in the mumbai consulate. I went for my H1 and my wife's and kid's H4 stamping. This is what happened in the interview.

Officer - Is this is new job
myself - yes.

Officer - How did u get this.
myself - I was applying in many companies. I have a friend in that company and I forwarded my resume to him

Officer- Right now u are working in XYZ in India.
myself - Yes

Officer - How well do you know ABC( the new employer)
myself - They have a good client base. I have good feedback about them as my friend is there.

But seems all these questions were just formalities. Because immediately she told this
" Sir, I am not in a position to issue you a visa today. You may have to wait for some time. Because there is some matter which requires a person to have a masters degree.
And so you will have to wait till that matter gets resolved"

This came as a shocking news to me.
I had got a H1 4 years back when my experience was even less than 2 years. And today somebody tells me my degree is not fit.

Anyways seeing me worried she continued
"This has nothing to do with ur case in specific. There are a bunch of people whose cases have been pending. This needs to get resolved from Washington(don't know how washington came into picture)/ You will be contacted very shortly say in a week's time".

I said " Mam would you like to see some other documents". Because I had so many docs but they asked only for I797 and I129. I had a letter from my employer to DHS while filing I-129 which clearly mentions that the requirement for this job is of a bachelor's degree and relevant experience and which I have.

She said " No I don't need any other doc. will get back to you".

I repeated " I have many other docs from my employer."

she repated " I said I don't need to see any docs".

That ended all conversations because after this there was no point in pressing and irritating her.

She returned all my docs ( pasport, I 797, I-129, passports, the drafts, marriage cert, birth certificate).

I had carried so may docs pertaining to my credentials ( like degree, transcript, my experience letters) and pertainign to my employer's credentials( like photos, LCA, letter to the consular officer). But she didn't ask for all this.

I am very frustrated. Don't know If I did some mistake there. Because the indian person from VFS initally asked only for these docs.

The 221(g) which I received mentions reason as "others"( there are many check boxes like Differnt consulate office, finger print, docs needed, W-2 forms needed and at the end there is a check box others. This was ticked by her. and she wrote "pending".

Guys Please let me know.
1. What does all this imply. Will they contact me?
2. Without any concrete reason why shud this be done?
3. Was the officer speaking the truth that there are a bunch of such cases?
4. How long will all this take. Will she actually call me in a week's time?
5. What are the chances for a final acceptance or rejection?

New H1b are not available as of now. They have introduced 20, 000 new ones but there is still a confusion that whether Masters from the USA is required for them or not.

This is your 1st H1b right ( I mean not a transfer )

Hi There,

I would suggest you not to worry bcoz i just read about the rule that 20k H1 which were available for Master's degree is now open to all aliens but still USCIS need to give go ahead which they will do in soon i am not sure abt time. I would suggest you to be patience and i am sure you should get your visa once this issue is cleared.

I think 20,000 visas that we are talking about is about fresh petitions. I am talking about stamping. So an approved petition has nothing to do with the prevailing quotas and rules. isn't it

Revalidation Stamp

Hi

I am in situation where I have to go to India.My case is:

I was working with Company A with which my Visa was getting expire on April 4 th 2004 so they filed the extension. Now, it was approved on June 21st but the revalidation papers (I 797) never came and it was lost in mail.
I transfered my visa to company B.
I have recieved all the papers(transfer paper I 797) .

Will that be a problem going for Stamping in India(New Delhi) without that missing extension paper(I 797)?

Also I go the stamp for company A in May 2002 but they called me in October 2003. but since I wasnt on project they never file taxes for me as they werent paying. so I dont have W2 for 2003. Can they ask W2 for 2003? and can I say that I never for paid in 2003? or I never worked in 2003?

Guys help me out

As they have checked the box 'other' it may not point any deficiency on your side but
they may be waiting for a general clarification(on some thing they have rised )on H1b issues from state dept.washington.
So you may have to wait(if time is indicated by them)and contact after that
interval.20,000H1s issue is nothing to do with your case(as your's is already approved and doesn't come under cap at all).Wait and hope for the best.

Thanks for your supporting reply. This is exactly what was told by the consulate officer that they are waiting from some clarification from washington on a bunch of cases. I hope she told the truth to me. But actually I was not able to visualize what can be the reason. And on the other hand they are issuing H1s to many people. so what is they found in me or my company's data.

I think the consular who has interviewed you was confused with 2000 quota. But your's was already approved. You should have shown her the LCA start date. Don't worry they will call you soon
 
Hi All,
I didn't get a call from the consulate yet.
Today I came to know that the consulate people gave a call to my present company in India where I am working. The HR person in my company told me that. I was in an embarassing situation. Anyways apart that I didn't get what are the consulate people up to. Are they cross verifying by calling up the places where I have worked. Infact its better because that way their doubts will be clear. But what are they actually looking for that they are checking the references. That day the officer was talking about my degree not being a master's degree. They didn't ask for any documents from me during the interview. I am very much confused.

The consulate officer had told me she will get back to me in a 1 week. That gets over tommorrow, So after that shall I give a call and ask them the status.

Friends please advise.

Email is the best way to contact them. You can try calling them but i heard that they will not answer these kind of questions.
 
Do not worry you will get a call back from the Consulate soon. They are basically trying to check your Employers background and also yours. I had a smiliar case a year back and did get a call but after a month or so. So they will call you back but it may take a while, don't loose your heart.
