H1 Revalidation Required ??

Hello Everyone,

I came to US in 2003 on H1 visa which is valid till June 2006 and was working for Company 'A'.

In these two and half years, I have changed my employer twice, company 'B' and Company 'C' with whom I am currently employed.

Both the companies have filed for an H1 petition and the current company petition is valid until 2008.

Now, the I-94 with me says June 2006 and I need to travel for a wedding in india in May 2006.I shall return by May 15th 2006.

Under these circumstances, do I need to get my Visa revalidated at a consulate in India ?

Please advise.

HI There..thanks for your response...just a clarification..I came to US in November 2003..so from that standpoint, I haven't stayed for more than 3 years...The only thing is that my H1 visa stamp which is valid until June 2006....has the name of my first empoyer on it...

There is no such rule that staying 3 years requires you to have revalidation.There are a bunch of people who did not get revalidation for 4 years, 5 years,.....
Visa revalidation is only to get new visa stamp which is needed to enter the US.
If you have valid stmap, you do not need new one.
If you have valid H1 stamp when you come back, show currentH1 approval notice as well as valid H1 stamp at POE, and they'll give you I94 for the validify of current H1 petition(til 2008)
