My H1B expires on Oct 11th 2006. My company is in process of filing my LC under PERM on or around March 1, 2006. Hence I was told that I would have to recapture my time on H1B so that I can file for my 7th year extension starting March 1, 2007. Hence, I would have to be outside the county for a period of around 5 months.
I have been outside USA for 70 days during my last 5 years of H1B. These stay have been spread across multiple visits to my home country on vacations ranging from 10 - 25 days.
My question is - can I use these 70 days of stay outside USA for recapturing, so that I can cut down on my forthcoming stay outside USA to 3 months?
