h1 out of status query

Hello Friends -

I have a question about being out of status and it would be great, if someone can provide some detailed info about.

I will be completing 6 yrs on H1 B visa in Oct 2010.

I have approved labour and my 140- approval was received in July 08. However I cant proceed further as no dates for 485 .

Now, My employer is under bankruptcy and they can close this office anytime. In that case, my job will be terminated with one day notice.

My questions is -

1. Should I proactively transfer my H1 to another company so I can remain in status ?

2. Is there any grace period when job on H1 is terminated ?

Transfer H1 and join new employer.

Talk to lawyers ASAP and look for the new sponsor.
In general, if LC or I-140 got void, there is a chance that your eligibility to the 7th year maybe considered lost, and you should clarify this part with lawyers.
