H1 Max. Year Reached, When I can reapply

Hi
I would appreciate if some one please answer this question.

I have reached the maximum number of years on H1 and came back to india in Aug,08.

Do I need to wait one year i.e. aug, 09 to reapply
Or
I can reapply in April,09 as approval will be only for nov,09 which is more than one year from aug,08 when I came back.

At the time of submitting your application(petition) to USCIS, you should have fulfilled the one year stay out side US.

Approval date does not count.
