H1 holder Married to spouse with GC.

Hi,

I am on H1 presently working in US. I recently married to a girl in India who has a Green Card with her. Can anyone tell me what should I do to? Should I apply for my GC thru employment or spouse? How much time does it take to get the GC?

Further Question on GC thru marraige

Hi,

My present H1 expires on Oct 2008. Incase I apply my GC thru my spouse, which may take some 4-5 yrs, is it possible I can apply for my H1 visa extension in that period? This is my second 3 year H1 filed for this firm and I have about 17 months for my H1 beyond 2008 for the time I was back in home country during my visa tenure.

Extension of H1 (if possible) would be the wisest choice till the I-130 PD becomes current and you apply for I-485. From that point on, you can use your EAD and not have to worry about your H1 anymore.
