Me and my wife are on H1 and H4 visas. Our current visas are getting expired on March 2004. I have an approved H1B extension until October 2005.
Recently when we went to India and came back. Immigration officer at the port of entry gave us I-94 with the new h1b expiry date ie.. Oct 2005.

Now I want to send our passports for stamping to St.Louis.

Do I need to apply for H4 extension separatly for my wife before I send for stamping ?

Will my new h1b approval is enough for her ?
I saw at "http://travel.state.gov/hlop.html"

"If the spouse and/or dependent children are applying for visas separately from the principal alien, submit certified copies of the principal alien’s valid visa and valid I-94 (front and back) in addition to the other listed requirements."

"A spouse/dependent applying separately from the principal alien must include the original or a photocopy of the principal alien's I-797."

This means.. if I send my documents.. will that be enough ?

Thanks in advance....

within US m your dependents need to file I539 in order to be eligible for a H4 stamp. So you cannot send for h4 stamping to st,louis just based on the H1 approval.

This is a little bit contradoctory..l I am in the same face too ..
But think about this scenario:
nothing harm sending the H4 along with the primary applicant .. You will get the visa .. i am pretty sure about this .. Becasue in our forums it self somany did that they got it ..
But keep in mind that you should file I-539 for her

Here all what we are doing is .. we are sending the passport little bit before assuming that our I-539 will through..
so we are saving time..
If we go through some of the threads .. people did this .. with out knowing .. and with knowing ..
Yes they got the passport back..
See one of our friend did the same thing without knowing .. But instead of filing I-539 he sent her wife to india and she entered again .. in usa .. becasue she got the stamp :)

pls check this

As you said you got already I-94 s extended for both of you till OCT 2005 .. your wife status is already extended .. Keep that I-94 always ..
You can confidently send her passport to revalidation along with you ..:)
